The users that have been registered will receive an email which will be sent to the email specified on the registration form, where the user will validate their registration by clicking on a link that will take the user to a second form which the user can complete by providing their name, surname, date of birth, email address and phone number. The completion of this part of the form is voluntary, however, the users that do not provide the information requested in the second form will not be able to use all the functions which are available with the Sherpa Application.
SHERPA will use the personal information that the user provided while completing the registration forms with the following objectives:
Depending on the services that the user requests through the Sherpa Application, some additional information might be requested of the user that is strictly necessary for the aforementioned service to function. At the moment of using the Sherpa Application, the user accepts and consents to the transmission, obtaining, maintaining, processing and use by SHERPA of the information provided by the users to carry out the service requested.
Additionally, when using the Sherpa Application, the user accepts and consents to the action of recording and sending what has been said or written by the user through the cellular device to SHERPA so that the petitions can be processed and the services fulfilled. This is a onetime recording that will be preserved only until the petition has been processed properly. You agree and acknowledge that some of these recordings can be stored on SHERPA servers in order to improve and optimize the quality of the system. This storage is temporary.
The user accepts and gives consent to the Sherpa Application to use the information included within the cellular device of the user, like his or her name, nickname, the names and nicknames of the people within the contact list, the relationships between the user and his or her contacts, the names of songs in the user’s personal library, the email addresses, the applications in use, etc. only to recognize and follow the instructions of the user.
If the user has the locational services activated, the position of the cellular device will be found at the moment of requesting information or providing functions through the Sherpa Application, also it will be sent to SHERPA, to help the Sherpa Application improve the accuracy of the responses to the petitions of the user based on his or her location. If the user wishes, he or she may deactivate the services which require the location of the cellular device.
In accordance with the Constitutional Law established 15/1999, on the 13th of December, of the Protection of Information of Personal Nature (LOPD) and in development regulations, the personal information that the user provide to complete the registration forms and when using the Sherpa Application, will be incorporated in a personal data file, owned by SHERPA, that will be appropriately registered and located in the Spanish Data Protection Agency (AEPD).
The user has the responsibility and obligation to maintain, at all times, his or her information updated, being the user, the only one responsible of the inaccuracy or falseness of the information provided and of the damage which may cause SHERPA or a third party. SHERPA reserves the right to cancel the account or restrict any user that has provided false information, without prejudice to other actions that originate in the user rights.
SHERPA may send information related to the service of the Sherpa Application to the registered users.
SHERPA will send weekly emails with information related to the new functions and novelties of the Sherpa Application.
The SHERPA services are designed for people over the age of 14, and so only people who are 14 or older may register as a user.
Some of the functions available by the Sherpa Application, included under point 4 of the General Conditions of SHERPA, like the “PayPal” service, are exclusively designed for people over the age of 18, and so only those people that are 18 years or older may use these functions.
SHERPA will not sell, give away or transmit the personal information of the users to a third party except for cases in which it is necessary and in agreement with the regulations which apply.
The user has the right at any moment to access, rectify and cancel his or her personal information either through the Website or through the Sherpa Application or oppose the manner in which that information is being used. To exercise this right, the user should write to email@example.com, attaching a copy of one of the following: Driver’s License, Passport or Social Security Card. The use of this email address is limited to carrying out the aforementioned rights, and is not established for technical service or consultation.
SHERPA hereby informs the user that the means, in which the technical nature and organizational functions are regulated and established, is done with the guarantee of the safety of the personal information of the user and never altered, lost or used without authorization, in accordance with the technical state, the type of data stored and the risks that may occur. All of this in accordance with the established law, Royal Decree 1720/2007, from the 21st of December, 2007, in which the Regulation for the development of the Organic law on the Protection of Personal Data (in accordance with the Spanish acronym LOPD)is followed.
The user may remove him or herself as a user of the Sherpa Application at any moment for any reason without a penalty, communicating the cancelation or removal from the program to SHERPA by sending an email to firstname.lastname@example.org and deactivating the Sherpa Application under the settings of the cellular device. The use of this email address is limited to carrying the aforementioned rights, and is not established for technical service or consultation.
